The TFWP facilitates the issuance of work permits to foreign nationals addressing labor shortages in Canada. Employers must provide a Labour Market Impact Assessment (LMIA) demonstrating no available qualified Canadians or permanent residents for the role.
During the pandemic, the LMIA validity period was extended to 12 months; however, as of May 1st, 2024, it will revert to 6 months, with Recognised Employer Pilot participants unaffected.
Previously capped at 20%, the proportion of low-wage TFWP workers in Canadian businesses saw a temporary increase to 30% in 2022, limited to specific sectors. Effective May 1st, 2024, only the construction and health care sectors may maintain this 30% limit.
Exemptions for the agriculture sector and seasonal employers remain unchanged.
These adjustments reflect Canada’s commitment to fortifying its immigration system amidst economic priorities. Recent measures include study permit caps and alterations to the Post-Graduation Work Permit (PGWP) program, addressing surges in international student enrollment.
